About This Platform

Underdog Talents is a sports recruiting profile platform that enables athletes to build and share professional digital profiles for recruitment purposes. The platform is operated by Services provided by Evandro Bambirra Assessoria, a company registered in Brazil (Belo Horizonte, MG, Brazil) under legal entity EVANDRO BARCANTE BRANDAO BAMBIRRA 01567074626, CNPJ 37.728.099/0001-52.

The platform is accessible globally, including to users in the United States, European Economic Area, Brazil, and South America. Where applicable, we comply with US federal law (including COPPA), EU regulations (including GDPR), and Brazilian law (including LGPD and the Consumer Defense Code).

02 — Eligibility

Who Can Use Underdog

Access to the platform depends on age and account type. We enforce these rules through technical controls at registration and throughout the platform experience.

03 — Accounts

Account Responsibilities

You are responsible for providing accurate and truthful information when creating and maintaining your account. Providing false information, including misrepresenting your age or identity, may result in account suspension.

You are responsible for keeping your login credentials secure. You must notify us immediately at support@underdogtalents.com if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your credentials.

04 — Content

Content You Upload

You retain ownership of all content you upload to the platform — photos, videos, stats, and profile information. By uploading content, you grant Underdog Talents a limited, non-exclusive license to display that content as part of your public or private profile, as configured by you.

You may not upload content that is defamatory, sexually explicit, infringing on third-party intellectual property rights, or otherwise unlawful. You must only upload content featuring yourself or individuals for whom you have explicit permission. Underdog reserves the right to remove content that violates these terms without prior notice.

For accounts involving minors, parents and guardians are responsible for ensuring that uploaded content is appropriate and that any individuals who appear in photos or videos have given consent.

05 — Billing

Subscriptions and Billing

Paid plans are available for athletes and managers. Subscriptions renew automatically on the selected billing cycle — monthly, quarterly, semi-annual, or annual — unless canceled before the renewal date. You may cancel at any time from your billing settings.

Payments are processed by Stripe. We do not store payment card details on our servers. By subscribing, you authorize recurring charges to your payment method on the selected cycle.

We reserve the right to adjust pricing with at least 30 days advance notice sent to your registered email. Continued use of the service after a price change constitutes acceptance of the new price. Refund eligibility is described in our Refund Policy.

06 — Managers

Manager and Managed Athlete Accounts

Manager-tier subscriptions include a set number of athlete slots (Pro Manager: 2, Agency: 5, Team: 10). Athletes managed under a manager's account access Pro features through that subscription. A manager is responsible for ensuring that athletes under their account have consented to being managed on the platform.

If a manager cancels their subscription, managed athletes will lose access to Pro features associated with that plan. Managed athletes retain their own accounts and any content they have uploaded.

07 — Minors

Minor Athlete Protections

We implement technical and procedural safeguards to protect users under 18, in compliance with the Children's Online Privacy Protection Act (COPPA), the General Data Protection Regulation (GDPR), and Brazil's Lei Geral de Proteção de Dados (LGPD).

We do not use data from minor athletes for advertising, behavioral profiling, or marketing purposes. Parents and guardians may request access to, correction of, or deletion of their child's data at any time by contacting support@underdogtalents.com. We will process these requests within 30 days.

08 — Prohibited Uses

Prohibited Uses

You may not use the platform to:

• Impersonate another athlete, person, or organization
• Upload false, misleading, or fabricated athletic statistics or credentials
• Scrape, crawl, or harvest data from the platform by automated means
• Use the platform to send unsolicited messages or spam other users
• Attempt to gain unauthorized access to another user's account or our systems
• Upload content containing malware, viruses, or harmful code
• Use the platform for any purpose other than lawful athlete recruitment and profile management

Violation of these prohibitions may result in immediate account suspension and, where applicable, legal action.

09 — Termination

Account Termination

You may delete your account at any time from your account settings. Upon deletion, your profile and associated data will be removed from public view within 24 hours and permanently deleted within 30 days, except where retention is required by law (such as billing records).

We may suspend or permanently terminate accounts that violate these terms, engage in abusive behavior, submit fraudulent information, or create security risks for other users. We will attempt to notify you before termination unless the nature of the violation requires immediate action.

10 — Liability

Limitation of Liability

The platform is provided on an "as-is" basis without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free. We are not responsible for recruiting outcomes, decisions made by scouts or coaches based on profile content, or third-party access to profiles that are set to public by the user.

To the maximum extent permitted by applicable law, Underdog Talents' liability for any claim arising from use of the platform is limited to the amount you paid in the three months preceding the claim. This limitation does not apply where prohibited by mandatory consumer protection laws in your jurisdiction.

11 — Governing Law

Jurisdiction and Governing Law

These terms are governed by the laws of the Federative Republic of Brazil. Disputes are subject to the courts of Belo Horizonte, Minas Gerais, Brazil, unless mandatory local law in your country requires otherwise.

Users in the European Economic Area also have rights under applicable EU consumer protection regulations and GDPR, which take precedence where required. Users in the United States are also subject to applicable US federal law, including COPPA for minor users; California residents have additional rights under the CCPA/CPRA as described in our Privacy Policy. Brazilian users have additional protections under the Consumer Defense Code (CDC) and LGPD.

12 — Changes to Terms

Updates to These Terms

We may update these Terms of Service at any time. When we make material changes — such as changes to pricing terms, liability, or user rights — we will notify registered users via email or an in-app notice at least 14 days before the changes take effect.

Continued use of the platform after the effective date of any changes constitutes your acceptance of the updated terms. If you disagree with a change, you may cancel your account before it takes effect. The "last updated" date at the top of this page reflects the most recent revision.

13 — Intellectual Property

Intellectual Property Rights

The Underdog Talents name, logo, brand identity, platform design, underlying code, and all related intellectual property are owned by or licensed to Evandro Bambirra Assessoria. Nothing in these terms grants you any right to use Underdog Talents' trademarks, service marks, logos, or trade names without our prior written consent.

Your content remains your property as described in section 04. The limited license you grant us to display your profile content does not transfer ownership of that content to us and terminates when you remove the content or delete your account.

14 — Indemnification

Your Indemnification Obligations

You agree to defend, indemnify, and hold harmless Underdog Talents, Evandro Bambirra Assessoria, and their respective officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the platform in violation of these Terms of Service
• Content you upload that infringes the intellectual property rights or privacy of a third party
• Misrepresentation of your identity, age, or credentials on the platform
• Your violation of any applicable law or regulation in connection with your use of the platform

This indemnification obligation does not apply to claims arising from Underdog Talents' own negligence or willful misconduct, and does not override any mandatory consumer protection rights you may have under applicable law.
